2. Payments | Full payment must be received
before items are dispatched.
3. Cancellation | Payments are non-refundable,
and clients are asked to advise us as soon as possible of any
hire cancellation.
4. Currency | all hire fees are charged in Australian
Dollars ($AUS).
5. Payment methods | All payments must be made
in Australian Dollars ($AUS). Payment can be made via Visa,
American Express or Mastercard through Paypal. Payment can also
be made by cheque quoting order number on reverse, made payable
to Bijou Jewels and sent to our Brisbane head office address.
6. Payment By Cheque – Goods will not
be dispatched until the cheque is cleared (usually 3 days).
If a cheque is returned by a client’s bank as unpaid,
Bijou Jewels will seek to advise the client immediately. A fee
of $25.00 will be levied and clients are required to make payment
in full by an alternative method before items are dispatched.
7. Secure payment | We will endeavour to take
all reasonable care, in so far as it is possible to do so, to
keep all details of your order and payment secure. In the absence
of negligence on our part we cannot be held liable for any loss
you may suffer if a third party procures unauthorised access
to any data you provide when accessing or ordering.
Paypal is a secure payment company which uses
SSL (Secure Socket Layer) encryption technology. As such, Paypal
will not release any customer payment details including credit
card numbers to Bijou Jewels. Please see the Paypal website
for more information on secure online payments.
8. Pricing | Bijou reserve the right to amend
pricing up or down or to amend discounts or introduce special
offers at any time. This will not apply to existing orders.
9. Pricing Structure | The pricing reflects
the underlying value of the item.
10. Complimentary Extras | Hire orders of 3
pieces or more will only be eligible for a complimentary gift
if they are part of the same order and qualify for the gift
as stated on the website.
11. Cancellation by Bijou Jewels | Bijou Jewels
reserves the right to cancel any order if they deem it appropriate.
Clients will receive written notification. Due to the increasing
number of fraudulent credit card transactions Bijou Jewels reserve
the right to refuse to supply goods, or ask for further proof
of identity. Additionally, if we suspect a fraudulent transaction
we cannot be held responsible for late/non delivery of your
goods.
12. Accuracy of information | We have made every
effort to ensure that the information contained within this
website is as accurate as possible. Please note that colours
displayed will depend upon the settings of your computer and
monitor and it is therefore impossible to guarantee that the
colour your monitor displays will accurately represent the colour
of the product ordered.
13. Allergic reactions | Bijou Jewels is not
responsible for any adverse reaction suffered by any client
whilst wearing any item of jewellery. All earrings are cleaned
and sterilised prior to the date of hire.
14. Lost goods | Any item which is lost whilst
in the care of a client must be paid for. The full replacement
cost will be twice that of the original item price. The cost
of the replacement must be paid in full within 14 days of invoice.
15. Damage to items | If damage is noted at
the point of return, the client will be advised immediately
in writing. Clients are liable for any and all repairs required.
These repairs will be completed by the jeweller nominated by
Bijou Jewels. The cost of repairs must be paid in full within
14 days of invoice. In cases where the damage renders the item
unsuitable for repair the client is liable for the full replacement
cost of the item, which is twice that of the original item price.
16. Fast Track Orders | These are only possible
on a case by case basis. Please contact our Brisbane office
via email.
17. Delivery Costs| Bijou delivers Australia
wide, and all delivery costs include return postage fees. All
payments are required prior to the item being dispatched.
While we do endeavour to deliver by the date
you have requested, this is not always possible due to unforeseen
circumstances. Late delivery does not constitute the failure
of our agreement, and does not entitle you to cancel your order.
Weekend deliveries are made each Friday or before
and should be returned on the Monday following. All other deliveries
are organised on a 48 hours turn around. Longer hire periods can
also be arranged and will incur an additional cost.
18. Non-delivery | It is your responsibility
to inform Bijou if an order does not arrive. Once we learn an
order has not arrived by the due date, we will lodge enquiries
with Australia Post to ensure delivery occurs as soon as possible.
We will not be held liable for any loss or damage resulting
from late delivery.
Please note that if an item has been lost in transit, we will
not send a replacement item immediately. Replacement items will
be sent according to our discretion.
19. Delivery Information | It is the obligation of the client
to enter the correct delivery address details at the time of
ordering. Should you enter the wrong address, we are not obliged
to re-send the order to the correct address at our expense.
20. Receiving faulty or damaged goods | Please
check the goods on delivery. If the goods are delivered faulty
or damaged you must inform us immediately. If you do not inform
us on receipt of delivery we shall have no liability for goods
said to be faulty, damaged or specified incorrectly.
21. Return of goods | All items must be returned
in their original condition, ie. clean, intact and in the original
packaging in which it was sent.
22. Failure to Return - All items must be returned
at the agreed date and time. If the item is returned the day
after this date the cost of the hire will be levied again. Delays
which exceed 2 days without notification will be regarded as
theft and the client will be charged twice the cost of the original
hire price.
23. Order Times | A minimum of 1 week notice
is required for all orders, however short order periods are
negotiable (see item 16).
24. Ownership and copyright | All items remain
the legal property of Bijou Jewels at all times during the agreement.
Copyright in the information and materials on the www.bijoujewels.com.au
website is owned by Bijou Jewels. This site or any portion of
this site may not be reproduced, duplicated, copied, sold, re-sold
or otherwise exploited for any commercial purpose that is not
expressly permitted by Bijou Jewels.
25. Website | Bijou Jewels does not accept any
responsibility for any web site not under our control, which
may act as a portal to our site or be connected by a link with
our site.
26. Legal Disclaimer | These Terms and Conditions
shall be governed by and construed in accordance with the laws
of Australia. In the unfortunate event that a dispute should
arise, this shall be exclusively subject to the jurisdiction
of the courts of Australia.
